An Ibadan-based internet fraud suspect, Oyesanmi Ayomikun Oluwaseun, has been sentenced to four months in prison for sending pornographic and indecent images through his email address.
Oyesanmi was sentenced on Tuesday, March 19, 2019, by Justice Joyce Abdulmalik of the Federal High Court sitting in Ibadan, after he pleaded guilty to a one-count amended charge filed against him by the Ibadan Zonal Office of the Economic and Financial Crimes Commission (EFCC).
The amended charge followed a plea bargain request made through his counsel and his expression of remorse during the course of the investigation.
As part of the arrangement, the EFCC withdrew the initial six-count charge bordering on alleged forgery of documents and obtaining money by false pretence and replaced it with a single count relating to the transmission of pornographic and indecent images.
According to the prosecution, investigations by the EFCC established that Oyesanmi allegedly used the email address to send pornographic images while posing as a woman in his communications with intended victims.
The commission alleged that the scheme was aimed at inducing victims to send him money.
His arrest followed a complaint lodged with the EFCC by a man identified as Michael Clark, who alleged that Oyesanmi had obtained $500 from him.
Oyesanmi was subsequently arrested by EFCC operatives in Ibadan on January 31, 2019.
The charge against him stated that he knowingly transmitted pornographic and indecent pictures through a computer system and network to Clark using the email address.
The alleged offence was said to be contrary to Section 24(1)(a) and punishable under Section 24(1)(b) of the Cybercrimes (Prohibition, Prevention, Etc.) Act, 2015.
After considering the terms of the plea bargain, Justice Abdulmalik sentenced Oyesanmi to four months’ imprisonment, with the sentence taking effect from the date of his arrest.
In addition to the custodial sentence, the court ordered him to return the $500 obtained from the complainant.
He was also ordered to forfeit an iPhone 8 Plus, an HP laptop charger and a wristwatch to the Federal Government.
The EFCC was represented in the case by its prosecuting counsel, Mr. Shamsuddeen Bashir.
